CLC Praises Bloch v. Frischholz Decision, an Important Fair Housing Precedent of the Federal Court of Appeals in Chicago 11/24/2009
Last Friday, November 13, 2009, the federal appeals court in Chicago, the Seventh Circuit Court of Appeals, held that a Jewish family could proceed in its case under federal fair housing laws against its condo board president and association, reversing its previous decision to the contrary. The Bloch family alleges that the condo association, under the guise of its hallway clutter rule, prevented them from placing a mezuzah on their door frame, repeatedly removing them, including on the day of a family member’s funeral. (A mezuzah is a small piece of parchment in a case that observant Jews place on their door frames.) The Chicago Lawyers’ Committee for Civil Rights Under Law, Inc. and its Fair Housing Project applaud this decision. The unanimous en banc opinion in Bloch v. Frischholz is an important precedent, and its impact goes far beyond the parties in the case.
